Regain Our Historic Village Character

The Subcommittee for the Historic Village Character of Manchester is requesting a vote by the Manchester Community Council members at this months meeting on March 28th, 2006. Vote to modify language for lot aggregation.
 
A subcommittee member has addressed the following issue with the Department of Community Development regarding lot aggregation. The DCD seems willing to modify the language with the approval of the Manchester Community Council. This would allow a grandfathering of properties in common ownership prior to the adoption of the Manchester Plan if a residence does not currently encumber both lots. This modification will restore only lots to those property owners that had separate tax parcels or plats prior to the adoption of the Manchester Plan. It will not create new lots following the adoption of the Manchester Plan. 
 
The Subcommittee for the Historic Village of Manchester has overwhelmingly approved this modification. The following is the current and modified change we request for vote by the Manchester Community Council members.
 
(A.Nonconforming Lots in Single Ownership.   If a single lot of record, legally created before the adoption of the Manchester Community Plan, is less than 8,712 square feet in size or does not meet the dimensional requirements of its zone, the lot may be occupied by any use permitted within the zone subject to all other requirements of this chapter. ( current: no change )

(B.)  Nonconforming Lots in Common Ownership.   If there are contiguous lots of record held in common ownership, each lot legally created before adoption of the Manchester Community Plan, and one or more of the lots is less than 8,712 square feet in size or does not meet the dimensional requirements of its zone, the lots shall be combined to meet the minimum lot requirements. If one or more of the lots is sold or otherwise removed from common ownership after the adoption of the Manchester Community Plan, it will not be considered to meet the minimum lot requirements of this chapter. Change request
( B.)    Nonconforming Lots in Common Ownership.   If 1) there are contiguous lots of record held in common ownership, each lot legally created before adoption of the Manchester Community Plan, 2) one or more of the lots is less than 8,712 square feet in size or does not meet the dimensional requirements of its zone and 3) a residential structure encumbered more than one of the lots at the time of adoption of the Manchester Community Plan, the lots shall be combined to meet the minimum lot requirements of its zone. If one or more of the lots is sold or otherwise removed from common ownership after the adoption of the Manchester Community Plan, it will not be considered to meet the minimum lot requirements of this chapter. A lot(s) that does not meet criteria 1 through 3 in this subsection may be occupied as specified in subsection A above.

2/28/06 Update:

Mike Valentino reported that the group continues to focus on:

  •  Lot aggregation (for properties in common ownership)

  •  Height variations from the 28’ standard in the Manchester Village Plan 

Under the topic of lot aggregation, Mike explained that there are about seven properties in the Manchester area that are affected by the lot aggregation requirement.  He said that any lot which does not meet the 8712 ft² minimum requirement and has an adjoining lot under common ownership, the two lots must be “aggregated” together.  He said that the committee is working on a proposal to present to the MCC membership which would add a clause to the Plan such that a if an existing home does not currently occupy both lots on properties subject to aggregation, then those lots will be grandfathered and not require aggregation.
